UPON PAYMENT of the sum of $______ ______ paid by Buyer to Seller (The Purchase Price ) receipt of which is here by acknowledged, Seller grants ,sells, conveys and transfers ownership of the following dog ( The Dog ) to the buyer:

The parties accept and agree to be bound by the attached Terms and Conditions governing the purchase and sell of the Dog.

        TERMS AND CONDITIONS 

1. Deposit, payment of purchase price: Buyer has paid a deposit of $ ________, with the balance of $ _________ due to the seller. Payments may be made in Cash, or Zelle. Deposits and final payment will be made in an agreed upon method. Deposit amount is due to reserve the dog and balance is due upon the pickup of the dog. If the buyer is having a flight nanny for shipping, the balance is due 10 days before the flight. Deposits are non-refundable, in the instance of special circumstances and the buyer cannot purchase the dog and has put down their deposit, they may request a dog from a future litter within one years time. Upon seller’s agreement to the special circumstances from the buyer.
2. Transfer of ownership: Upon payment in full of the purchase price, the seller shall promptly take all actions required to officially transfer ownership of the dog to the buyer. Prior to leaving, The dog will have been vet checked, have a Florida state health certificate, a one year health guarantee from congenital health defect, current vaccines, de-wormed, and microchipped in the name of the seller, we always keep our information in the microchip of the dog. The name of the seller will not be removed from the microchip for any reason, but we will add your information as soon as the agreement is final. Faucheux’s Finest Frenchies LLC will be the primary contact information; the new buyer's information will be listed secondary. This is to ensure the dog has a safe home at all times, if the dog gets lost or stolen the seller and buyer will work together to get the dog back to the buyer. If this contract is broken and the dog is relinquished to a rescue, adoption agency, ASPCA or any other type of organization the buyer is terminating all rights as the owner of this dog and the dog will be released to the breeder all expenses will be covered by the buyer.
   This dog is being sold as a pet home only with no breeding rights. The buyer cannot transfer ownership to another breeder for whatever reason. If the buyer cannot or does not wish to maintain custody (at any time during its lifetime) the buyer is to notify the breeder immediately in such case. If the dog is sold or given away without the breeders written consent the buyer is responsible for damages in the amount of $6,000 .If the dog is surrendered to Faucheux’s Finest Frenchies LLC the buyer is relinquished as the owner. 
3. Seller’s Representations and warranties: Seller’s represents and warrants to buyer that: 

A: Seller is the legal and true owner of the dog and that seller has full right and authority to sell the dog. 

B: The dog is being sold free and clear of any lien, security interest, charge or other encumbrance.

C: Seller guarantees that the dog is a purebred french bulldog.

D: The dog is in good health and free of communicable diseases at the time of this sale. Buyer has three days from the delivery date to have the dog examined by a licensed veterinarian, at the buyer's sole expense. If the dog fails the examination, the buyer may return the dog with a written statement from the veterinarian, for a different dog from the same litter, if one is available or a dog from a future litter within ONE year (minus shipping if applicable). Failure by the buyer to have the dog examined within the three day period will nullify this warranty. If the buyer chooses to keep the dog, no replacement will be given and all medical costs and treatments are the sole responsibility of the buyer.

E: This guarantee does NOT cover Cherry eye, Entropion, Ectropion, Allergies, Undescended Testicles , Inverted Vulvas, Loose knees or Hips, Stenotic nares, Elongated soft pallet, Hernias, Dermatitis, Demoted Mange, Any heart defect, Seller will NOT replace a dog due to heat stroke, abuse/ neglect,  or improper socialization. Buyer agrees to keep the dog away from other dogs ,parks, pet stores, grassy areas etc. until 18 weeks of age and has received final vaccinations.
Buyer agrees that they have thoroughly researched the french bulldog breed and understands the many health issues that they can possess. Buyer is responsible for all medical costs of their dog. (NO refunds will be given). This guarantee covers only the original buyer and is not transferable. 

F: To ensure that the buyer does not euthanize the dog or take the dog to an animal shelter, the seller will take the dog back at any time during the dog's lifetime. Seller will not issue a refund or provide another dog to the buyer unless the dog's return was a result of any misrepresentation on the part of the seller with respect to the dog's health within the first year.

Fitness of purpose: 

The dog was bred as a companion animal, the seller does not provide any  warranty as to the dogs fitness for any specific purpose, including obedience trials, show ring performance, and/ or breeding purpose. Seller is not responsible for the dogs ability to breed or the quality or size of the litters. There are no guarantees when it comes to the size of the dog, eye color, or coat color as the dog grows into an adult. 

 4.     Buyers representations/Responsibilities: Buyer represents to seller that: 

A: Buyer will have the dog spayed or neutered by the age of 18 months. But not before  8 months old to make sure the Dog has the right time to mature. 

B: the dog resides with the buyer as a companion pet to the buyer and buyer’s family. 

C: Buyer will keep the dog in an enclosed adequate size yard/home, and will not allow the dog to roam at will. Buyer will not keep the dog chained tethered or permanently house the dog in a kennel. 

D: Buyer will provide the dog with nutritious food and necessary veterinary care, including deworming, heartworm prevention and regular vaccinations (including rabies).   

E: Buyer is not acting as an agent for any other person or business in the purchase of the dog 

F: Buyer will not sell, give, or release the dog to a petshop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such businesses or facility. 

 5.   Entire agreement: 

This agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warrants, express or implied, unless specifically stated in this agreement.
